Can you wish on an Internet site that someone meets "the end of a Magnum?" Or tell them, "I hope you die soon?" How about accuse them of "possible fraud" or ask if they've paid a local politician a bribe? What if you do it anonymously? Or under a made up name? What if your Web administrator writes this stuff?
A defamation lawsuit filed in Philadelphia Common Pleas Court asks these questions, and pits local publicist and man-about-town Anthony DiMeo III against Tucker Max, a New York writer and man-about-town, who uses his web site to chronicle long nights of drinking and debauchery. And apparently annoy DiMeo endlessly.
Call it the Blueberry Heir v the web's bad boy.
DiMeo, 30, is suing Max, also 30, saying Max's widely-read web site has libeled him repeatedly.
Max, a Duke Law school grad who is representing himself, says he's done nothing of the sort.
Max has gained some notoriety for his writing, landing his book "I Hope they Serve Beer in Hell," on the New York Times best seller list (No. 26) and finding himself in court for publishing a full-frontal account of his sex life with a former Miss Vermont. He won, and has posted the gory details about the case on his site as well.
He describes himself on his website as an #$%hole. His emails carry this blurb from the Times: "...highly entertaining and thoroughly reprehensible..."
Juicyness aside, the case has the potential to test the constitutionality of the recent change to the Communications Decency Act of 1934 that makes it illegal to "annoy" someone anonymously on the Internet.
For the past two years posters on TuckerMax.com have ridden DiMeo for the way he uses his own web site to promote his parties, his acting career, his Renamity pr firm, his being heir to a blueberry farm in South Jersey. DiMeo's suit, filed by attorney Matthew B. Weisberg, of Morton, Pa., asks for $150,000 in compensatory damages as well as punitive damages of another $1 million.
Tucker Max's comment section lit up after DiMeo made the news in January for his $100-per-head New Years Eve party at Le Jardin where attendees grew unruly after alcohol ran out, well before midnight. He has since sued the restaurant, and the restaurant has made a counter claim.
Commenters on TuckerMax.com rode DiMeo hard, Max acknowledges. Weisberg said the words hit him in his pocket. "One of his businesses is a pr firm," Weisberg said. "As you may know, he hosted a New Year's Eve party which made it into the papers as being riotous. The contract with an alcohol distributor didn't provide enough alcohol. If one of your businesses is pr, and it is solely a business based on reputation, and you are being accused of criminal conduct, or simply being harassed, why would I want to hire someone who himself has been portrayed poorly in the public?"
Weisberg also represents DiMeo in a libel suit against Philadelphia Weekly and columnist Jessica Pressler, who parodied one of his annual holiday greeting cards.
By contending that Max's site violated the new law that prohibits anonymous annoyances on the Web - the Violence Against Women and Department of Justice Reauthorization Act of 2005 - the comments also represent criminal behavior, the lawyer alleged. He added, "I am only interested in money. I don't care about Tucker Max going to jail. It's how can I compensate my client, and make sure (Max) does not do like things again."
Max, meanwhile, argues that nothing said on his web site is libelous. He says that he is not responsible for comments that posters made on his web site - even if they were defamatory. Lawyers for the Electronic Frontier Foundation and Ralph Nader's Public Citizen Litigation Group take the same position.
"I see this lawsuit as an attempt to intimidate and stifle free speech on the Internet," Max said. "Dude, I don't see myself as a hero or champion or crusader. I'm just a dude who writes funny stories on the Internet."
Paul Alan Levy, an attorney specializing in free speech on the Internet for the Public Citizen Litigation Group, read the lawsuit at Blinq's request, and concluded:
"It's hard to see much of a defamation claim in much of this stuff. Writing 'You are the biggest piece of #$% I have heard?' that's not defamatory. It may be nasty. That is opinion."
It is less clear, he said, whether it's defamatory to post that someone was guilty of possible fraud or of bribing a politician, but Max uttered neither of those comments, and so is not liable, Levy said. Levy called the annoyance law clearly unconstitutional - a view shared by the Electronic Frontier Foundation.
"If some of these comments were put on by an employee of Tucker Max, that seems to be a different question," he said.
DiMeo's an idiot -- can I say that? Max may offend some people with his writing, but DiMeo's history is one that suggests he's never had to deal with any real criticism his entire life. DiMeo's trail of intimidation suits speaks for itself. Hopefully he (DiMeo) will learn a little bit about reality from this experience.
DiMeo is such an idiot that it's gotten to the point where he is now laughably stupid instead of just laughable.

DiMeo just wants to be famous, he doesn't care how and for what. Unfortunately he isnt interesting or talented and has to be in public fights to get the fame he do desperately wants. Anthony DiMeo is a walking joke. The guy is more lawsuit-happy than Metallica, his PR firm is a laughing stock, and his lawyer is a fool for taking on his case. This lawsuit is either going to be cut and dry, or it's going to cause a lot of public outcry. If free speech stops existing on the internet, how long until our phone calls start being monitored? Emails? The issue being raised here is not ego vs. ego, it's freedom vs. suppression.
I fail to understand how a man who tirelessly attempts to buy his way into fame would respond to criticism so poorly. Ashlee Simpson did the same thing, but when people made fun of her she just rolled with it. DiMeo, on the other hand, seems to file a lawsuit any time people think lowly of him. The truth is, Max's popularity will only further DiMeo's negative public image (if you'd call it that). Regardless of the outcome of any court case, DiMeo only stands to lose what is clearly most important to him - any shred of respect anyone might have garnered for him. It's tragic, and a clear indication of where he's headed. What if he appeared on an entertainment news show? What if they made fun of him there? Would he sue them? Honestly. Every decent celebrity on the face of the planet has had loads of criticism and has dealt with it accordingly. So how could someone like DiMeo, who is not really a celebrity but more of a failing poser do something so counterintuitive? It's like he's trying to blow any chance he ever had of becoming a low-card actor.
All Max said on his board was that DiMeo's party was a GIGANTIC failure..Which it obviously was. Why should he be held accountable for the opinions of those who commented on the article he linked to?
If anything, this is just someone with sand in their vag.. its ok.. most of us can roll with the punches of everyday life.. DiMeo seems to not know how this is done. Freedom of Speech protects against things you wont want to read....
Tucker's site is good comic relief. Why would anyone want to take it seriously is beyond comprehension. Come on people there are more serious issues that we should be worried about, instead of some spoiled heir who got his feelings hurt.
Dimeo should spend a little more time rehearsing his off, off, off-Broadway adaption of Brokeback Mountain with his close personal friends (and by friends I mean his attorney and other manservants, of course) and less time worrying about the rather obvious opinions people post about him. In theory, since he owns a PR firm, he should expect the public (that's the P in PR, last I checked) to form an opinion based on his promotional events, gatherings, and projects. He'd like it to be a good one, but it just so happens everyone forms the same opinion - he's generally worthless (except perhaps to a few fans of the oft maligned blueberry, a fruit that I believe to be...well, that's another post entirely).

The internet is the last place in the world where someone can express their opinions without some form of backlash, and these new censorship laws are trying to encroach on that. This attack on Tucker Max is absurd. There's a real easy soloution if you don't like his website or his book...don't read it. This is very real. I have been following Tucker Max for months - ever since I saw that tiny link from Maddox' site. Having been a "lurker" in Tucker's messageboard for several years, I can safely say that his site (even, yes, the infamous Forum) doesn't really promote character assasination. Whenever someone is being lampooned, such as in the DeMayo case, he did something so irrevokably stupid that he pretty much deserves the humiliation. If I understand Dimeo's postion, he is stating that public opinion on a message board is libelous. If he believes this to be wrong he must also object to the media broadcasts of public demonstrations such as the Million Man March or similar events. These activities are distinctly protected in the bill of rights: the right to assemble peacably. Dimeo has no ground to stand on, other than the Mature content on Tucker Max's site. Tucker will decimate this ignoramus in court.

There is a very straight forward legal issue here. Is the host of a message board responsible for the things people post on it. The answer should be "no". It would be the same as saying that a restaurant owner would be responsible for some patrons having a libelous conversation in his or her restaurant. The fact of the matter is that DiMeo has come down with a bad case of Bill O'Reilly sindrome and thinks that no one should ever speak poorly of him. DiMeo makes a claim that these opinions on the message board hurt his stupid PR firm. That is simply untrue, the crappy party he threw and the horrible job he did planning it are what is hurting his PR firm. Basically, DiMeo seems to have the point of view that if he does something well it should be the topic of conversation but if he screws up no one should be able to talk about it, which is just asinine. Also, there have been a few people on here who seem to think that if by some long shot DiMeo actually wins this case that his website will go down. WRONG. The worst thing that could happen to his website would be the closing of the message board. First of all, any comments made in a public message board are the popular opinion of the people DiMeo is trying to make 'relations' with. If the general concensus thinks the person is an idiot and does not deserve anyone's business, I would think that it's a good idea for more people to heed the warnings. Besides, take into account media critics. If these people think that a movie or a song someone produced wasn't all that great, it's their right to tell others about it. Negative reviews happen everywhere from magazines and newspapers to Internet websites. That's all that Tucker and his message board effectively did, they placed their review of DiMeo on the message board. A message for DiMeo and anyone else supporting him: If some 'asshole' can call you one and have everyone agree, maybe the problem isn't with them, and maybe PR isn't your best field.

This law suit is a prime example of a spoiled rich kid that can't take it when everyone isn't worshipping the ground he walks on. All he is doing is throwing a glorified temper tantrum. This lawsuit is just a waste of everyones time.
First, no judge will ever rule in favor of DiMeo simply because of how many people would try to use this case as precedence after the ruling. Second, the Renamity Public Relations Firm is completely f**cked, and all I feel sorry for all its employees who work for a company owned by a man who is too self-centered to realize he is going to lose a ridiculous amount of money when his firm and the lawsuit fail. Who will hire a firm who is owned by a man who can't even keep himself in good relations with the public. This kinda reminds me of the movie "Jay and Silent Bob Strike Back". In the end of the movie, the protagonists fly around the country beating up everyone who used an internet site to make fun of comic book/movie characters based on Jay and Silent Bob's likenesses. Very childish. I mean, it's not the exact same thing, but you can see my point.
Apparently, the old saying that there's no such thing as bad publicity has been proven wrong as DiMeo has shot himself in the foot (unfortunately not in the head). If his career in PR wasn't already over thanks to the NYE party fiasco, he just officially killed it by a) showing that he can't take criticism, b) attempting to trample on the constitution of the USA, and c) proving that he never had any PR skills in the first place because no one in that business with an IQ greater than 10 would dream of drawing that kind of attention to himself. On top of all else, he's wasting a judge's time and taxpayer money on a law suit so frivelous that it should be criminal.
I totally agree with DiMeo; we need to set up a society where people are constantly in fear of getting sued or put in jail for what they write. We should establish committees and directorates to determine what is and isn't acceptable discourse. Seriously, DiMeo should have to pay all court costs and Tucker's legal fees after he loses (and since Tuck is representing himself, he should charge $1500 an hour).

Tucker Max's stories may be offensive, however, not illegal. Not to mention the fact that if you don't want to read them, you're not forced to. To make legislation against Max's website and similar material would be completely asinine. To do so would be a direct indictment against our freedom of speech as American's. Our freedom to express is one of our greatest freedoms. Granted, it is in the form of explicit stories, it is still the right of Tucker Max to express himself as he wishes. It is our right as Americans to express ourselves as we wish.
While I can kind of see where DiMeo is coming from on this one, I have to agree that the law (and common sense, really) is squarely on Tucker's side. For one thing, it wasn't him that said any of those things, it was people on the forums. And another thing: that law that DiMeo and his attorneys cite is definitely going to be thrown out or reversed sometime in the near future. I'm pretty sure there are already cases in the works for that. And nobody seems to have brought up that DiMeo is only suing Tucker because he has the money. There would be no lawsuit if Tucker wasn't popular and successful. It's not like every internet joe who posts on forums is a millionaire, right?

I agree with a lot of what's been said--but the biggest point being, if people don't like something, that don't read it. Also, it sounds like Dimeo needs to get a backbone or grow a set. Get over yourself and your lawsuit. It's utterly ridiculous. I actually just finished reading Max's book, and though there were parts I could have done without, I thought overall it was great, and I laughed outloud. I just received an email from Dimeo himself. Apparently he came across my ad in Craigslist and thought him and I would be a good match. He's retarded. I hear awful things about his joke of a PR firm and now have first hand knowledge of what a joke this man is. I just learned this evening of these postings relating to Anthony, and let me tell you that this dosen't sound like Anthony. It just dosen't. I know him. I worked with Anthony DiMeo, and like many people, I fell a bit in love with him (dont tell my fiance!). He is such a good guy, with so many endearing qualities. I love his funny little giggles, the cute little bounces he does when up to mischief (frequently!) and his constant call for adventure to begin. It is hard to get your head around somebody so full of life, but I am sure we can count on him to be stirring up good things for a long time to come. He has promptly filed a formal appeal with the U.S. Court of Appeals for the Third Circuit. Oral arguments in this matter are now scheduled to be heard before the panel of Third Circuit federal judges. DiMeo said the defamation case is not over by any any means.
